Abercrombie & Fitch, a clothing-store chain, agreed to pay $50 million to settle a lawsuit in which employees accused the chain of promoting whites over minorities and cultivating a virtually all-white marketing image. Pursuant to the settlement, Abercrombie & Fitch must pay $40 million to racial-minority employees and job applicants and $10 million for attorneys' fees and to monitor compliance of its changes. In the suit, Asian and Latino groups claimed that Abercrombie & Fitch hires a disproportionately white sales force and places racial minorities in less-visible jobs. "The retail industry and other industries need to know that businesses cannot discriminate against individuals under the auspice of a marketing strategy or a particular 'look,'" said Eric Dreiband, EEOC general counsel.
