First of all, does Florida state law allow a false entry on a prescription for that reason? If not then it doesn't matter except for P.R.

Secondly, whether this violates terms of the agreement will be decided by a judge, not a jury, and I think the standards are much lower ("more likely than not"). The judge wasn't born yesterday - they'll have heard every excuse in the book before - and the prosecution may not have to work very hard to show that this does violate the order.

Now one defense might be that the Viagra wasn't for Rush. Maybe he traveled to the Dominican Republic to meet his gay Daddy, who wanted the Viagra for an extra-special session with Rush...
