Not applicable here. Statements against penal interest are a RoE exception for hearsay, whereby you can testify about things someone told you, your observations (a person acting spastic shortly after a person is murdered nextdoor), and other things that typically are not allowed under the Rules of Evidence if the person in question is available to be deposed.
