Actually TD I heard a dj on the radio today saying that a year and a day allows the possibility of early release, something about anything over a year. If this dj was rightand it is true it should work out better for her than just a year.

In every court around here the added day means hard time. A misdemeanor is a sentence of up to but not including one year, one year and up is felony territory. Even year sentences can get parole in every case I was ever involved with, but the added day was done so early release was impossible.
The DJ just might be correct., and I'll be damned if I know the law of the state she was convicted in. I just don't see how adding time to the sentence would help secure an early release in any state.
I'm still betting the year and a day ain't a good thing.
But what do I know; I've lost in court a time or two. But the win column is still much higher.
