Little, whose pornographic character goes by the name Max Hardcore, lives in California, but was tried in Tampa after investigators here ordered his films through the mail and downloaded them on the Internet. Little's lawyers say in a motion filed late Thursday that they plan to appeal Little's conviction on seven grounds, including the argument that federal obscenity laws violate the right to sexual privacy and are "unworkable when applied on the Internet." The lawyers also maintained that U.S. District Judge Susan Bucklew, who presided over the trial, erred when she allowed prosecutors to present excerpts of the films in question, rather than the entire films and that she erred again when she wouldn't let the defense play the entire DVDs. The lawyers also maintain that Bucklew formed her own conclusion about Little's guilt before the prosecution was finished presenting its case. They say Little is not likely to flee before going to prison because he has known for a long time about the investigation, did not flee and because he traveled to Tampa for every required court appearance. According to evidence in the trial, federal investigators in January 2006 purchased an online membership to the Max Hardcore Web site and downloaded five promotional video clips. Then, in March 2007, an undercover postal inspector bought five DVDs from the Web site, having them delivered to a post office box in Tampa. The videos featured scenes of vomiting and urination, depicting scenes of women being forced to ingest various bodily fluids.

THANK YOU for your expert legal opinion Mr. P. But Lou Sirkin and I think we WILL WIN, otherwise we wouldn't have filed it now would we. But maybe you know more than Lou.
In any case, if I don't eventually win, I'm going stand up like a man and fight. And if they beat me, so be it. At least I can say I did my best, and that's good enough for me.

Sounds more like "I'm going to sit back and let ofhters speak for me instead of defending myself and my content."
Freedom of speech also means the freedom to remain silent. You talk a good game here, but when it comes to the courtroom all i hear is the crickets chirping.

Seriously dude, what the fuck is your problem with Max? He has a well paid attorney that knows the ins and outs of the legal system representing him at considerable cost. If Max is quietly sitting in court and observing while his lawyer is vigorously running his defence, I'm pretty sure that's exactly what the lawyer told him to do.
I also think that Max isn't going to win this appeal, not because his case is weak or because he's done something wrong, but because this whackjob judge couldn't even spell impartial, let alone actually be impartial.

This will get overturned by the supreme court. I pretty much guarantee it. It just sucks that Max has to foot the legal bill for this bullshit.
Doesn't it bother anyone that Max just went from wealthy taxpayer to being involuntary guest of the government at a cost of $60,000 per year? Primarily because some prude went LOOKING for his stuff and decided that it was offensive?
I mean, if we're going to put people in jail for being offensive, why isn't Rush Limbaugh there? Why isn't Dane Cook rotting in a jail cell somewhere? Why is Carrot Top a free man? How could Danny Bonnedeuce possibly not be incarcerated?
I think it's a sick irony that Bill O'Reilly wanders around accosting people with his Bullshit while Max Hardcore essentially goes to jail for essentially trying to live the American dream.
(And if you think the American dream isn't pissing on hot women, fucking them in the ass and then paying them to go away, you really haven't been paying attention.)

I don't think it will ever get there. It will be reversed by the Eleventh Circuit on procedural issues, ignoring the Miller issue. I doubt the next AG will consider obscenity enough of a priority to proceed.

I hope you're right Jim. About everything. I don't know enough about the American legal system to know where exactly it will get overturned, but it's nice to know some of the checks and balances are still there.
