From ADULTFYI:Vehicular Manslaughter Charges in Surewood Case; Arraignment Set for Later Today VAN NUYS- (KABC-TV) - Two men accused of a crash that killed a five-year-old boy and injured his mother and baby sister are due in court Wednesday. That arraignment is set for later Wednesday. Both suspects in this now notorious case are facing multiple felonies stemming from last Tuesday's road-rage crash. The accident ended up killing a 5-year-old boy in Reseda. Police say 19-year-old Armando Gamboa Ayon of Pacoima and 44-year-old Brian Barnes [aka Brian Surewood] of Northridge got into a road rage dispute while driving on Sherman Way between Balboa and Louise. Both men apparently tapped their brakes to make the other swerve and crash. Ayon's Maxima plowed into the rear of a parked car, knocking it into a second parked car. Standing in between those parked vehicles were a 31-year-old mother and her two children, a five-year-old boy and a two-month-old baby girl. The little boy died as a result of his injuries, his mother and baby sister were critically injured. The mother's legs were crushed and one had to be amputated. Ayon remained at the scene and was immediately taken into custody. He made his first court appearance last week for his bail hearing. The second suspect, Barnes, fled the scene, but later turned himself into police. Both men have been held on $1.5 million bail. Later Wednesday they will be arraigned on vehicular manslaughter charges and several counts of reckless driving. Barnes will also face three felony counts of leaving the scene of an accident. + + + This appears to be yesterday's, but it's all I found. I'm guessing the Grand Jury failed to indict on Murder chrarges. Usually, a prosecutor will try to indict on a Murder charge (Murder 2, Depraived Indifference here in NY, I'm not sure about California) and work downward from there. If such a Murder charge actually went to trial, the Judge would likely allow Manslaughter/Vehicular Homicide as lesser-included offenses.

Depends on many factors, including the caseloads of the Court and the LA DA, neither of which I'm familiar with. Another major factor is the amount of time the Defenses' experts will need to gain access to, and then evaluate, the evidence. I know that some jurisdictions take their time in making physical evidence available to the defense. You'd have to ask Pornlaw what LA's record is like.

Four questions:
1) Does Surewood have any prior felonies?
2) If no to question 1, do the three concurrent felony charges he now faces apply to the '3 strikes' law
3) If convicted of vehicular manslaughter what kind of sentence could he expect to receive from the state of California?
4) Are there other pirates in jail or will he be the only one?

We (Brian) pled not guilty and we have been set for a conference on December 3rd to set the Preliminary Hearing date. I have associated in the firm of Jonathan Kissel. Kissel and former Van Nuys DA, now defense counsel, Peter Korn will be handling the vast majority of the criminal case and I will be assisting as well. We expect a Prelim date in January. Why does it seem CA always does "Preliminary Hearings" and not "Grand Juries"? Is there an option? A prosecutory benefit?
I would think a prosecutor would prefer a Grand Jury where s/he pretty much runs the show.
[i.e., Judge Wachtler's: "A grand jury would indict a ham sandwich."]

Fatman: Grand Juries and Preliminary hearings are two seperate things and they occur in every state. Basically, a Grand Jury determines whether the People have sufficient evidence to proceed to trial and, if so, they issue an Indictment stating what, specifically, the accused is charged with.
Preliminary hearings, depending on the state, can address anything from Bail to evidentiary issues.
Michael: There have been conflicting reports in the media. What, specifically, is Brian charged with: Murder, Manslaughter, Vehicular Homicide, Leaving The Scene? How do his charges differ from the kid in the other car?

Whether he likes it or not Brian is going to look as corporate and upstanding as possible for the duration of the trial, as snooty as the lawyers if possible. That's how you know it's really serious: they make you were a tie. Hmmm.... Jeff was prepared to start the trial a few days ago. Anybody got any pics of him?
