XBiz story AVN story Federal Grand Jury Charges Two Companies and Owner John Stagliano With Obscenity Violations WASHINGTON, April 8, 2008 /PRNewswire-USNewswire/ -- A producer of allegedly obscene movies and two companies owned by him have been charged by a federal grand jury in Washington, D.C., with operating an obscenity distribution business and related offenses, Assistant Attorney General Alice S. Fisher of the Criminal Division announced today. In an indictment filed by the grand jury today, Malibu, Calif. resident John Stagliano and two of his companies, Evil Angel Productions, Inc. and John Stagliano, Inc., both located in Van Nuys, Calif., were charged with three counts of using a facility of interstate commerce to sell and distribute DVDs containing obscene films together with a movie trailer in violation of 18 U.S.C. SS 1465; two counts of using a common carrier for the conveyance or delivery of DVDs containing obscene films in interstate commerce in violation of 18 U.S.C. SS 1462; one count of engaging in the business of selling or transferring an obscene film and a movie trailer in violation of 18 U.S.C. SS 1466; one count of using an interactive computer service to display an obscene movie trailer in a manner available to a person under 18 years of age, in violation of 47 U.S.C. SS 223 (d); and one count seeking forfeiture of certain assets of the defendants under 18 U.S.C. SS 1467. According to the indictment, the defendants, producers of the films charged in the indictment, distributed the films to the public by means of common carrier and the Internet. If convicted, Stagliano faces a maximum penalty of five years in prison on each of the obscenity counts charged under Title 18, United States Code, and two years on the count charged under Title 47, United States Code. The corporations face a maximum penalty of $500,000 in fines per count. An indictment is merely an accusation. All defendants are presumed innocent of the charges and it is the government's burden to prove a defendant's guilt beyond a reasonable doubt at trial. The case is being prosecuted by Trial Attorney Pamela Satterfield of the Obscenity Prosecution Task Force of the U.S. Department of Justice, with support from the U.S. Attorney's Office for the District of Columbia. Investigation was done by the Federal Bureau of Investigation's Adult Obscenity Squad based in the Washington, D.C. field office. The Los Angeles Police Department also assisted in the investigation.

It's shitty to release the indictment before informing the defendants what the materials were or when the offense occurred.
Gain momentum with the indictment while the defendants struggle just to find out where the water is leaking in.
These are bitch moves you expect on American Gladiator not from the US Government. I bet Gen. U.S. Grant would be ashamed, pack up the Army of the Potomac and head home if he knew things would come to this.

Holly - thanks. Rob was just an asshole, I don't know Max as a person, and I'm sure a lot of people here saw that Jeff and I had our differences, but through all of their cases, I always supported their right to make their movies, which they never forced a single person to HAVE to watch against their will. Our lawyer is Allan Gelbard. He also represents JM, and he's amazing. Hopefully tomorrow we'll know which movies. The NewsWire item went out from the government before John was served or received any notification. We actually found out because the editor of XBiz saw the NewsWire feed and asked me how we were doing. Bornyo- thanks. See, THIS is why I'm such a wacky libertarian. Hopefully he doesn't plead guilty. You should fight this not just accept the punishment that is handed.
If I were to guess, I would think that the movies that were obscene were something to do with Belladonna. It would be obscene to have someone get a broken jaw while tied up to a chair in a scene. Poor Kelly.

My point here is that even if you are guilty of what they are trying to bring you to justice for, you should plea, "NOT GUILTY". What this will do is create a court case in which you and John can win. This is your best option. They may offer you much lesser charges if you take the plea bargain, but if I were you, I would not take these deals even though you will be tempted. 4 years in prison sounds much better than 40 doesn't it?
I have to ask, has the thought crossed your mind that if John does go to prison, that you will have full access to all of his money while he is away? You can buy designer gowns and diamond tennis bracelets. Maybe you can do that big addition you have been wanting. Do not fall prey to these feelings. If you turn on John in court, nobody in porn will respect you and the evil empire will crumble.

It's called "pacifying the base." As far as I know, McCain has never taken a stand on Porn, so the admin has to do it for him in order to keep the bible-thumpers happy this election season.
I am surprised there's only eight counts charged, out of the whole Evil Angel catalogue. Either the Feds learned their lesson after Jeff's persecution or this really is just a half-hearted attempt to make the nuts happy. Either way, good luck to you both.

The choice of Washington, D.C. as a venue is puzzling, since the "community standards" of the District are a lot different from, say, Arizona (where Jeff's case was held) or the Northern District of Florida (where Max's case is being tried.) Hell, they're arguably more "advanced" (for lack of a better term) than the standards of Pittsburgh, where Rob Black's case is still winding its way through the Courts.
And what about the titles cited? I'm not familiar with the works in question, but they sound pretty tame by E.A. standards. And the Belladona title is just an on-line trailer? Isn't there anything in the entire Bella canon that they could have picked that would have offended community standards more than a trailer?
To me, it seems that the Gov't isn't really serious about prosecuting this case at all, and that this is just for show. It reminds me of the ongoing trial of the three cops in the Sean Bell shooting in Queens, the prosecution of whom is quarter-hearted at best.

They both sound like the 5th circuit ct of appeals in New Orleans, which covers TX. If you are up for murder, mayhem, obscenity, inter alia, you may want to have appeals heard elsewhere (not that you can choose).
I'd like to read the indictment to see whose community standards "Fetish Fanatic 5" violated. Can't be DC. I used to work near 14th and Mass Avenue, Near Thomas Circle - full of working girls and even "adult book stores."

Yes... and did you have a part in getting Fetish Fantastic 5 and those other movies out to the public? In your opinion, do you think Jay Sin was a plant by the government to get you indicted? It seems convenient that he starts directing there and a few months later he already has 4A reviews and a 5 star indictment. He has been in porn for years and has never had an indictment before.
Just watch your backs if he comes off as a friend during this entire thing. Also, don't be surprised if the government contacts Kelly Wells to cry on the stand about Belladonna's abuse tactics or jaw breaking. A young lady with a permanent medical disability would be strong in the case against you.
