I would image this will be the first of many internet based production companies filming outside of California that will be prosecuted over the next year. If the Bush Admin starts to act like the Reagan Admin and begins to direct local prosecutions, the pander/prostitution/RICO charge might become quite popular as a way for religious Republican DAs to make a name for themselves.

I doubt highly that Florida will legalize adult production. California's judiciary is much more liberal.

I hope they get off. They don't deserve this bullshit just so some politician can make a name for themselves!

This could also have sweeping effects across the US if a non-favourable precedent is set.

I doubt this will hold up. The Florida Supreme Court is uber-liberal. They're farther left than Rush is right. Remeber when they did everything in their power to get Al elected? I bet these justices areto COHF right now.

ummm...which state supreme court are we talking about? surely not the one that STOPPED the recounts, thus insuring that big Al would not get elected.

Hopefully the outcome will be as favourable as the decision in California. Then maybe we can all rest easier about this bullshit.

If the lawyers are setting up a defense fund I doubt if this will ever see the Florida Supreme Court. Unless they are willing to waive a large portion of their legal fees. Which in essence means it will probably be plead to a lesser charge(s) and it will quitely go away without any real legal ramifications.

It will be interesting to see if the industry in Florida steps up and helps. If I were Bang Bros I would offering to help pay the legal costs. If not they could be next on the list.

People vs Freeman is the California case by which porn-production was protected in that state. Wikipedia says

Quote:

The State of California unsuccessfully tried to have this judgment overturned by the United States Supreme Court. Justice Sandra Day O'Connor denied a stay of the California Supreme Court's judgment, finding that its ruling was founded on an independent and adequate basis of state law. The full Court subsequently denied the petition for review.

As a result of this precedent, the making of hardcore pornography was effectively legalized in California.

does scotus' action here in no way protect producers outside of california?

That would be the U.S. Supreme Court that correctly gave the election to G.Dub who won the election. The Florida Supreme Court is the one that wanted to recount using different methods until one gave the election to Al.
