Terms of a civil settlement are irrelevant for testimony in a criminal trial. The court compels her testimony and any civil agreement wouldn't even be brought up.

If the trial didn't start it can't be part of the trial record. Police records are not trial records.

The right of a defendant to cross-examine evidence is fundamental to American court proceedings. If the police want to introduce a transcript of what she said to a cop then Polanski has the right to question that cop as to the accuracy and completeness of the transcript. The prosecution does not get to assume the cop didn't lie in making the transcript.

There are rare exceptions to this but he'd have to kill a witness to prevent them from testifying to get hearsay allowed.

Polanski has dual French and Polish citizenship. That would be enough to get US interest were positions reversed.

From the Swiss standpoint I imagine they wouldn't mind doing a rejection on the US right now if France gave them some cover. Politics works like that - "if you screw with my banking system then I'm not going to be real cooperative when you want it." Were this something less noxious than child rape it's a lot more likely the Swiss would let him go just to tweak the US.
